These terms govern your use of BedWatch Africa. In short: BedWatch Africa is an information and routing service, not a hospital, ambulance, or insurer — it does not guarantee bed availability or admission, and always call 112 in a real emergency. By using the platform you accept these limits, the pricing in Section 4, and Ghana as the governing jurisdiction.
1. Parties and Platform Operator
BedWatch Africa ("the Platform", "we", "us", "our") is operated by Babykaafo, a social enterprise registered in Ghana (Business Registration Number BN346832016), with its principal office at 49 Salem Road, Osu, Accra, Ghana.
BedWatch Africa Limited is being incorporated in Ghana as the legal entity that will own and operate the platform. Until that incorporation is complete, the platform is operated by Babykaafo.
"User", "you", "subscriber" refers to any individual, family, corporate employee, or institutional member accessing the platform.
2. What BedWatch Africa Is — and What It Is Not
Read this section carefully. It defines the nature and limits of this service.
BedWatch Africa IS:
- A real-time emergency capacity intelligence platform
- An information service that shows available hospital capacity based on data provided by registered facilities
- An emergency routing tool that suggests the nearest facility with reported available capacity
- A directory of Ghana Health Service-listed health facilities
- A platform through which subscribers can alert trusted contacts during emergencies
- A subscription service that includes access to the BedWatch Emergency Response Fund (BERF) for annual subscribers under separate terms
BedWatch Africa IS NOT:
- A hospital, clinic, or healthcare provider
- A medical advice service
- An ambulance service
- An emergency response service
- A health insurance product or regulated insurance product of any kind
- A guarantee of bed availability at any health facility
- A guarantee of admission to any health facility
- A substitute for calling emergency services (dial 112 for ambulance in Ghana)
- A guarantee of any specific health outcome
BedWatch Africa does not provide medical advice. Nothing on this platform constitutes medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare provider with any questions you may have regarding a medical condition.
3. Eligibility
You must be at least 18 years of age to create a subscriber account. Family plan primary holders must be at least 18. Family members added to a family plan may be of any age.
You must provide a valid Ghanaian mobile phone number or, for visitor accounts, a valid international mobile number.
You must have the legal capacity to enter into a binding contract under Ghanaian law.
4. Subscription Plans and Pricing
The following subscription plans are available. Prices are in Ghana Cedis (GHS) unless otherwise stated:
- Individual Monthly: GHS 5.00 per month
- Individual Annual: GHS 60.00 per year — includes BERF access
- Family Monthly (up to 5 members): GHS 20.00 per month
- Family Annual (up to 5 members): GHS 240.00 per year — includes BERF access
- Day Pass: GHS 15.00 for 24-hour access — no BERF access
- Institutional plans: per-head pricing as agreed at institutional account setup — see Institutional Account Terms
Visitor and diaspora plans are priced in USD. See Visitor and Diaspora Terms for visitor-specific pricing.
BedWatch Africa reserves the right to change pricing with 30 days' notice to active subscribers. Price changes do not affect subscriptions already paid for the current billing period.
5. Payment
Ghana subscriber payments are processed via Paystack. By subscribing, you authorise Paystack to charge your Mobile Money account or card on the billing cycle you select.
Visitor and international subscriber payments are processed via Stripe.
All prices are inclusive of any applicable taxes unless otherwise stated.
Failed payments may result in suspension of access until payment is successfully processed.
6. Accuracy of Facility Data
Critical limitation: BedWatch Africa displays health facility data including bed availability status. This data is entered by facility staff and may not always be accurate, current, or complete.
BedWatch Africa does not independently verify real-time bed availability data. The platform relies on registered facility staff to update their status. Facilities may not update their status regularly, may experience technical issues, or may have changed their capacity since their last update.
BedWatch Africa displays a staleness indicator showing how recently a facility’s data was updated. Users should treat any facility whose data has not been updated within the past 2 hours as potentially inaccurate and should call the facility to confirm availability before travelling.
The Platform expressly disclaims any warranty or guarantee regarding the accuracy, completeness, currency, or reliability of any facility data displayed.
7. Emergency Routing
The emergency routing feature suggests the nearest health facility with reported available capacity based on your GPS location and facility data at the time of query. This suggestion:
- Is based on data available at the moment of query and may change within minutes
- Does not guarantee that the suggested facility will be able to admit you
- Does not constitute a reservation or booking at any facility
- Should always be supplemented by calling the facility directly if possible
- Does not replace the need to call emergency services (112)
The Platform accepts no liability for any loss, harm, injury, or death arising from reliance on emergency routing suggestions.
8. Hospital Notification
When a subscriber triggers the emergency button, BedWatch Africa sends a notification to the selected health facility. This notification:
- Is a best-effort communication and is not guaranteed to be received or acted upon
- Does not constitute a confirmed admission or reservation
- Does not obligate the facility to admit the subscriber
- Depends on the facility having active staff monitoring the BedWatch Africa portal
9. Trusted Contact Alerts
By adding trusted contacts to your profile, you authorise BedWatch Africa to send SMS messages to those contacts containing your name, the name of the hospital you are being directed to, and your emergency status. You confirm that you have obtained the consent of each trusted contact to receive such messages.
10. Intellectual Property
All content, features, functionality, data compilations, software, and design of the BedWatch Africa platform are owned by Babykaafo / BedWatch Africa Limited and are protected by Ghanaian and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without express written permission.
11. User Conduct
You agree not to:
- Provide false information during registration
- Use the platform for any unlawful purpose
- Attempt to interfere with, compromise, or circumvent the security of the platform
- Submit false emergency triggers
- Use automated tools to access the platform without authorisation
- Reverse engineer any aspect of the platform
12. Termination
BedWatch Africa reserves the right to suspend or terminate your account without notice if you breach these Terms, engage in fraudulent activity, or use the platform in a manner that endangers others.
You may cancel your subscription at any time. See the Refund and Cancellation Policy for refund and cancellation terms.
13. Limitation of Liability
This is a critical clause. Read in full.
To the fullest extent permitted by Ghanaian law, BedWatch Africa, Babykaafo, their directors, officers, employees, agents, and partners shall not be liable for:
- Any death, personal injury, or health outcome arising from use of or reliance on the platform
- Any inaccuracy in facility data or routing suggestions
- Any failure of the emergency button, hospital notification, or trusted contact alert system
- Any failure of a health facility to admit a subscriber
- Any loss of data, revenue, business, or opportunity
- Any indirect, incidental, special, consequential, or punitive damages
- Any claim arising from BERF fund payments or non-payments
Where liability cannot be excluded by law, BedWatch Africa’s total liability to you for any claim shall not exceed the total subscription fees paid by you in the 12 months preceding the claim.
14. Indemnification
You agree to indemnify, defend, and hold harmless BedWatch Africa and Babykaafo from any claims, damages, losses, liabilities, costs, and expenses arising from your use of the platform, your violation of these Terms, or your violation of any third party’s rights.
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Republic of Ghana. Any dispute arising from these Terms or your use of the platform shall first be subject to good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to the jurisdiction of the courts of Accra, Ghana.
16. Changes to These Terms
BedWatch Africa may update these Terms at any time. We will notify subscribers via email or in-platform notification at least 14 days before material changes take effect. Continued use of the platform after changes take effect constitutes acceptance of the new Terms.
